Utah Gun Laws in Plain English
In Utah, you can carry a concealed handgun without a permit if you are 21 or older and legally able to own a gun. You can buy almost any type of firearm or magazine without state restrictions or waiting periods. While you don't need a permit to carry generally, getting one allows you to carry in K-12 school zones and provides reciprocity with other states. You can also carry on public college campuses.
Critical: Utah Gun Law Gotchas
These are the most important things to know that could get you arrested or charged with a crime:
- #1Constitutional Carry (permitless carry) does NOT exempt you from the Federal Gun-Free School Zones Act (18 U.S.C. § 922(q)). You need a Utah permit to be legally within 1,000 feet of a K-12 school.
- #2Utah Code § 76-10-505.5 specifically exempts permit holders from the state ban on carrying in schools; it does not explicitly exempt constitutional carriers.
- #3Churches can prohibit firearms by notifying the BCI or posting signs (Utah Code § 76-10-530). Carrying there after notice is an infraction or misdemeanor.
- #4While medical marijuana is legal under state law, you are still a prohibited person federally (18 U.S.C. § 922(g)(3)) and cannot purchase firearms from a dealer.
- #5It is illegal to carry a firearm while under the influence of alcohol or a controlled substance (Utah Code § 76-10-528).
- #6Loaded long guns in vehicles: While the penal code allows 21+ to carry loaded, wildlife regulations often require long guns to be unchambered to prevent poaching accusations.
- #7You cannot carry in secure areas of airports (Utah Code § 76-10-529). This is a strict liability offense in many cases.
- #8If you are 18-20 years old, you cannot carry concealed without a provisional permit; Constitutional Carry starts at 21.
- #9Private sales to known restricted persons are felonies (Utah Code § 76-10-503(9)).
- #10Brandishing: Drawing a weapon in a threatening manner (except in self-defense) is a Class A misdemeanor (Utah Code § 76-10-506).
- #11Federal buildings (Post Offices, Ranger Stations) are always off-limits, even with a permit.
