    Illinois Gun Laws in Plain English

    In Illinois, you must have a FOID card to touch, buy, or own any gun or ammo. You generally cannot buy AR-15s or magazines that hold more than 10 rounds for rifles or 15 for handguns. If you want to carry a concealed gun, you need a separate license (CCL) which requires 16 hours of training. You cannot openly carry a gun. All gun sales, even between friends, must go through a background check process.

    Critical: Illinois Gun Law Gotchas

    These are the most important things to know that could get you arrested or charged with a crime:

    • #1Possessing a single round of ammunition without a valid FOID card is a crime (430 ILCS 65/2).
    • #2The 'Assault Weapon' registration deadline passed on Jan 1, 2024. If you didn't register your AR-15 by then, it is now illegal to possess (720 ILCS 5/24-1.9).
    • #3A glove box or center console is NOT a legal case for transport. The container must completely enclose the firearm (People v. Diggins).
    • #4Non-residents cannot carry concealed outside their vehicle. You can only have a loaded concealed gun within your car if you have a permit from your home state (430 ILCS 66/40).
    • #5If you stop for the night (hotel/food) while traveling through IL with items banned by PICA (AR-15s, >15rd mags), you may lose FOPA protection and be arrested.
    • #6Marijuana users are federally prohibited. Even though IL legalized weed, having a Medical Marijuana card can complicate or revoke your federal rights to buy guns.
    • #7You cannot buy a handgun in another state and bring it home. It must be shipped to an Illinois FFL.
    • #8Short Barreled Rifles (SBRs) are only legal if you have a Curio & Relic (C&R) license from the ATF, in addition to the tax stamp.
    • #9Suppressors are completely banned for civilians, regardless of federal tax stamps.
    • #10Public transit (CTA/Metra) is a prohibited area for concealed carry.
    • #11Cook County and Chicago may have local ordinances that are preempted by the CCL Act for handguns, but they strictly enforce the state AWB.

    How do I transport firearms in Illinois?

    If no CCL: Must be unloaded and enclosed in a case. 'Case' is defined as a container that completely encloses the firearm. A glove box or console is NOT a legal case.

    Are short-barreled rifles legal in Illinois?

    While IL state law (430 ILCS 65/8(e)) attempts to exempt cannabis use from state prohibition, Federal law (18 USC 922(g)(3)) still prohibits possession by unlawful users. Purchasing a firearm requires completing Form 4473, where answering 'No' to drug use while using marijuana is perjury.
