Kentucky Gun Laws in Plain English
In Kentucky, you can carry a concealed handgun without a permit if you are 21 or older. You can buy firearms from private sellers without a background check, and there are no waiting periods or limits on magazine size. You can keep a loaded gun in your car's glove box without a permit. However, you must still obey federal laws, especially regarding drug use and carrying near schools.
Critical: Kentucky Gun Law Gotchas
These are the most important things to know that could get you arrested or charged with a crime:
- #1Constitutional Carry (permitless carry) does NOT exempt you from the federal Gun-Free School Zones Act (18 U.S.C. § 922(q)). You need a physical KY CCDW license to be legally within 1,000 feet of a K-12 school.
- #2Even though Kentucky legalized medical marijuana (SB 47), you are still federally prohibited from owning firearms if you use it (18 U.S.C. § 922(g)(3)).
- #3You must be 21 to carry concealed without a permit (KRS 237.109). If you are 18-20, you can generally only Open Carry.
- #4Carrying in a bar is legal, but carrying in the bar area of a restaurant is prohibited if you are drinking alcohol (KRS 237.110(16)). actually, the statute prohibits carrying in a room where alcohol is served *if* the establishment is primarily devoted to alcohol, or if you are under the influence.
- #5Private businesses can post 'No Weapons' signs. While these don't have criminal force (unless it's a prohibited place), you can be charged with trespassing if you refuse to leave when asked.
- #6You cannot carry in a meeting of a local governing body (like a City Council meeting) per KRS 237.110(16).
- #7While you can carry in your car without a permit, the gun must be in a factory-installed compartment (glove box, console, door pocket) if you don't have a permit. Leaving it on the passenger seat under a jacket could be considered 'concealed' illegally if you aren't 21+ (though 21+ constitutional carry covers this now).
- #8Kentucky recognizes all other states' carry permits, but your Kentucky Constitutional Carry rights do not automatically travel with you to other states.
- #9It is a felony to possess a firearm on school property (KRS 527.070), unless you are picking up/dropping off a student and stay in your vehicle (and even then, federal law is tricky without a permit).
- #10The 'Second Amendment Preservation Act' (KRS 237.102) prohibits state police from enforcing new federal bans, but federal agents (ATF/FBI) can still arrest you in Kentucky.
- #11You cannot carry in a police station or sheriff's office, even if you are just going in to ask a question (KRS 237.110(16)).
- #12College campus carry is not a state crime, but it can get you expelled or fired if the university prohibits it (KRS 237.115).
Read these carefully - they cover common mistakes that lead to felony charges.
