Tennessee has enacted new legislation, Senate Bill 350 and House Bill 469, which significantly alters landlord-tenant relations regarding firearms. Effective July 1st, landlords can no longer prohibit tenants from possessing, carrying, or storing firearms and ammunition within rental properties, including inside the residence, vehicle, parking areas, and common access points. This law voids existing lease clauses that ban firearms and provides tenants with legal recourse, including damages and attorney fees, if landlords violate these rights. The legislation asserts that constitutional rights do not cease at lease agreements, establishing a precedent that property rights do not supersede fundamental rights.
