Red Flag Laws - What Are They AND What States Have Them?
Red Flag Laws, also known as Extreme Risk Protection Orders (ERPOs), allow law enforcement, family, or medical professionals to petition a court to temporarily remove firearms from individuals deemed a danger to themselves or others. As of May 2023, 21 states and the District of Columbia have enacted some form of these laws. Critics argue they violate due process rights guaranteed by the Sixth Amendment, allowing for firearm confiscation without prior knowledge of charges or a committed crime, and are susceptible to abuse through false or exaggerated reports.
